Should I make qurbaani for myself or my family?

 

Question:

 

The Hadith of Rasoolulla Salalaahu Alay he wasallam says if you by the means to make Qurbaani and you don’t, one mustn’t even go to Eid prayer my question is I want to make Qurbaani but not myself for a family member (with my money) firstly do I fall in this category of Hadith, secondly is it better to rather Qurbaani for myself and if must u tell the family member what your intention ? And for a man married with kids, would it then be ok for him to slaughter on behalf of the kids and wife?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

To begin with, the Hadeeth in question is reported by Hadhrat Abu Hurayrah Radhiallaahu `Anhu who said that Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “Whoever has sufficient wealth and he does not sacrifice, then he should not even come close to our place of Salaah.” [i] – Authentic, from Sunan Ibn Maajah.

 

The Hadeeth does not mean that if a person doesn’t slaughter then he mustn’t come for the `Eid Salaah, but rather it is a warning to show the severity that if a person has the ability to slaughter and does not do so, then him making the `Eid Salaah will not be of benefit to him after ignoring the obligation of Qurbaani.

 

There are certain conditions that have to be met though before Qurbaani becomes obligatory upon a person, if those conditions aren’t met then Qurbaani would not be obligatory.

 

Imaam Al-Margheenaani Rahimahullaah says in Al-Hidaayah: “Udh’hiyyah is obligatory upon every person that’s free; muslim, a resident (not traveller), with sufficient wealth on the day of Adh’haa (to sacrifice) on his behalf and his young children.” [ii]

 

Now as for what is considered to be “sufficient wealth”, it is the Nisaab of Zakaah.

 

Imaam Badruddeen Al-`Ayni Rahimahullaah explains it in Al-Binaayah and says: “It is that a person possesses the amount of 200 Dirhams in excess of his house, furniture, clothing, slaves and weapons.” [iii]

 

Simply put, if a person on the day of `Eid has excess wealth to the amount of 200 Dirhams, which is equivalent to 612.36 grams of silver, and in the context of the South African financials as per today that amount would be R4200.78 (the Nisaab of zakaah), if he has that amount of excess wealth that is not a debt due to be paid then Qurbaani will become obligatory upon him. That wealth does not have to be in his possession for a full lunar year, rather it could have just come into his possession that very day and it will become obligatory.

 

If the animals are so expensive that a person only has enough money for himself, then he will slaughter for his own self only, if he has sufficient for himself and his wife and children then well and good he can slaughter for them all, but if he only has enough for one animal then he may not slaughter it for someone else, but rather he will have to slaughter it on behalf of his own self, because Qurbaani would not be obligatory upon those other family members who have no money but it will be obligatory upon him who is the possessor of that amount of excess wealth.

I want to ask how many shares I must slaughter in an ox

i want to ask that how many shares are must in an ox slaughter? please tell me in detail? thank you

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

An ox, like a cow, buffalo and similar animals contains seven shares, a single share is enough to fulfil the obligation for one person, it is not necessary to take all seven shares for your slaughter to be valid.

 

Hadhrat Jaabir Radhiallaahu `Anhu said that Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “A cow (suffices) for seven (people), and a camel (suffices) for seven (people).” Sunan Abu Daawood. [i]

 

Hadhrat Jaabir Radhiallaahu `Anhu also said: “We would make Tamattu` (`Umrah & Hajj in one journey) during the lifetime of Rasoolullaah Sallallaahu `Alayhi Wa Sallam slaughtering a cow for seven people and a camel for seven people while sharing in it.”Sunan Abu Daawood. [ii]

 

So you can have six other people join you in slaughtering an ox, provided that their intentions are to gain closeness to Allaah and not for the sake of the meat.

 

Imaam Al-Kaasaanee Rahimahullaah says in Badaa’i `us Sanaa’i`: “If seven people become partners in a camel or cow, all of them intending gaining closeness to Allaah by means of Udh`hiyyah and other types besides it that is done for gaining closeness to Allaah (e.g. such as the animals that are sacrificed as penalties on Hajj) but one of their intentions is only to get meat thereby (and not for any religious reason), then none of their sacrifice will be permissible, not the one intending Udh’hiyyah nor any of the others who intended gaining closeness to Allaah.” [iii]

Is qurbani wajib on a woman with no cash money

 

Question:

 

A sister ask she has jewellery to the value of plus minus R 30000.00. She has no cash money. Is qurbani wajib on her

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

If a woman has gold or silver jewellery and the gold/silver content reaches the Nisaab of Zakaah (not diamonds and other stones), then she will have met the condition of being wealthy, even if she does not have cash in hand, and as such she will have to slaughter.

 

Explaining the condition of being wealthy Imaam Ibn `Aabideen Rahimahullaah says in Raddul Muhtaar: “It (the condition) is that he owns two hundred Dirhams or goods which are equal to it (in price), excluding his house, his clothing or items that he is in need of in order to slaughter the sacrificial animal.” [i]

Respected مفتي sahab hope all is well اِنْ شَاءَ الله. What is the ruling regarding slaughtering sheep for qurbani that the tails have been cut by the farmers.

 

Answer:

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Udh’hiyyah or Qurbaani is a sacrifice for Allaah’s sake, following the Sunnah of our forefather Hadhrat Ibraaheem `Alayhis Salaam, therefore the laws governing these sacrifices are stricter than just slaughtering for meat.

 

One of the conditions for the acceptability of the animal is that it should be free of any major defect, based on the Hadeeth of Hadhrat Al-Baraa Ibn `Aazib Radhiallaahu `Anhu who said that  Rasoolullaah Sallallaahu `Alayhi Wa Sallam was asked which sacrificial animals should be avoided (for `Eid Al-Adh’haa), so he (Sallallaahu `Alayhi Wa Sallam) indicated with his hand and said:  “Four (types): The lame animal whose lameness is manifest, the one-eyed animal whose blindness is apparent, the sick animal whose sickness is clear, and the emaciated animal that has no marrow (or fat).”Muwatta Imaam Maalik Rahimahullaah. [i]

 

Hadhrat `Ali Radhiallaahu `Anhu said: “Rasoolullaah Sallallaahu `Alayhi Wa Sallam commanded us to inspect the eyes and ears (of the animal for defects).”Sunan An-Nasaa’ee. [ii]

 

The tail is like the ears, therefore Imaam Al-Margheenaanee Rahimahullaah says in Al-Hidaayah: “The one whose ear or tail has been cut off is not permissible.” [iii]

 [i]عَنِ الْبَرَاءِ بْنِ عَازِبٍ؛ أَنَّ رَسُولَ اللهِ صلى الله عليه وسلم، سُئِلَ: مَاذَا يُتَّقَى مِنَ الضَّحَايَا؟ فَأَشَارَ بِيَدِهِ، وَقَالَ: «أَرْبَعٌ  – وَكَانَ الْبَرَاءُ يُشِيرُ بِيَدِهِ، وَيَقُولُ: يَدِي أَقْصَرُ مِنْ يَدِ رَسُولِ اللهِ صلى الله عليه وسلم – : الْعَرْجَاءُ، الْبَيِّنُ ظَلْعُهَا. وَالْعَوْرَاءُ، الْبَيِّنُ عَوَرُهَا. وَالْمَرِيضَةُ، الْبَيِّنُ مَرَضُهَا. وَالْعَجْفَاءُ، الَّتِي لاَ تُنْقِي» – رواه الإمام مالك رحمه الله في الموطأ.

 

 [ii]أَمَرَنَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ نَسْتَشْرِفَ الْعَيْنَ وَالْأُذُنَ. – رواه النسائي رحمه الله في سننه.
