Am I allowed to rent out my gold and silver jewelry and receive payment for it?

 

Question:

 

Am I allowed to rent out my gold and silver jewelry and receive payment for it? Will it be considered interest?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Yes it will be permissible for you to receive payment for lending out your gold and silver jewellery, because it is being rented out as goods for the purpose of wearing and not as money, therefore it will not be considered as Ribaa.

 

Imaam As-Sughdi Rahimahullaah says in An-Nutafu Fil-Fataawaa:

 

“Renting out jewellery is permissible for men and women, if it is rented out for a set time with a set price, and once the set time is reached then it becomes necessary to pay the set amount of money regardless of whether it (the jewellery) was used or not.” [i]

 

Imaam At-Tahaawi Rahimahullaah says in Mukhtasaru Ikhtilaafil `Ulamaa:

 

“None of the jurists considered it detestable except (Imaam) Maalik (Rahimahullaah), for he considered it detestable but did not forbid it.” [ii]

Is it permissible to work in a bank as a sales assistant?

Question:

 

Is it permissible to work in a bank? As a Sales assistant? Will my earnings be halaal?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Banks are dens of ribaa (interest), and undoubtedly a person who works in such a place will be forced to deal in ribaa, thus making the person an accessory to the crime.

 

Allaah has stated clearly in the Qur’aan in Surah Baqarah, Aayah 275: “And Allaah has permitted trade, and prohibited ribaa.” [i]

 

Hadhrat `Abdullaah Ibn Mas`ood Radhiallaahu `Anhu reports that Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “Allaah has cursed the one who takes ribaa, the one who gives it, those who witness it, and the one who writes the transaction.” Musnad Imaam Ahmad Rahimahullaah. [ii]

 

On the same note Hadhrat Jaabir Radhiallaahu `Anhu said: “Rasoolullaah Sallallaahu `Alayhi Wa Sallam cursed the one who takes ribaa, the one who gives it, the one who writes it and those who witness it.” And he (Sallallaahu `Alayhi Wa Sallam) said: “They are all equal (in sin).” – Saheeh Muslim. [iii]

 

Taking this Hadeeth into consideration, it is clear that a sales assistant will fall under one of the types mentioned, whether it’s due to him writing up the contracts and transactions, being a witness to it etc as all of that is considered part of his job description.

 

Therefore it will not be permissible to work as a sales assistant in a bank.

 

And Allaah knows best.
