Are muslims allowed to consume duck?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Ducks are permissible to consume, because they are not clawed birds of prey, and Rasoolullaah Sallallaahu `Alayhi Wa Sallam only prohibited the eating of birds with talons in the Hadeeth of Imaam Muslim Rahimahullaah in his Saheeh:

 

Hadhrat `Abdullaah ibn `Abbaas Radhiallaahu `Anhu said: “Rasoolullaah Sallallaahu `Alayhi Wa Sallam prohibited (the eating of) every fanged animal of prey, and all birds with talons.” [i]

 

There is no evidence from the Sharee`ah to prohibit the eating of duck, in fact one understands its permissibility from the words of the Fuqahaa when they discuss the expiation required by a person that slaughters and hunts while in Ihraam, Imaam Al-Kaasaani Rahimahullaah says in Badaa’i`us Sanaa’i`:

 

“And similarly (it is permissible for a person in Ihraam to slaughter) chickens and ducks which dwell in homes, which is known as a Kaskari [ii]duck, because they are not considered as game, due to them not being wild.

As for the duck that lives with people and flies (is able to fly fully like pigeons) then it is considered game, because the meaning of game is found within it (so expiation is required).” [iii]

 

So therefore there is no harm in eating ducks.

 [i]عَنِ ابْنِ عَبَّاسٍ، قَالَ: «نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ، وَعَنْ كُلِّ ذِي مِخْلَبٍ مِنَ الطَّيْرِ». – رواه الإمام مسلم رحمه الله في صحيحه.

[ii] Kaskar is a place in Baghdad, and these ducks get their name from that place. They are tame and live amongst people, and fly like chickens.

 

 [iii]وَكَذَا الدَّجَاجُ وَالْبَطُّ الَّذِي يَكُونُ فِي الْمَنَازِلِ وَهُوَ الْمُسَمَّى بِالْبَطِّ الْكَسْكَرِيِّ لِانْعِدَامِ مَعْنَى الصَّيْدِ فِيهِمَا، وَهُوَ الِامْتِنَاعُ وَالتَّوَحُّشُ.

فَأَمَّا الْبَطُّ الَّذِي يَكُونُ عِنْدَ النَّاسِ وَيَطِيرُ فَهُوَ صَيْدٌ لِوُجُودِ مَعْنَى الصَّيْدِ فِيه. – قاله الإمام الكاساني رحمه الله في كتابه بدايع الصنائع.

Is it permissible to consume horse meat?

 

Question:

 

In light of the “horse meat” scandal which erupted in Europe not to long ago, I’m curious as to whether its permissible 2 consume horse meat? (Just curious)

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

It is permissible to eat horse meat, though it is better not to do so.

 

Imaam Abu Haneefah Rahimahullaah had originally been of the view that it is not permissible to eat horse meat, as Imaam Al-Margheenaani Rahimahullaah mentions in Al-Hidaayah:

 

“It is (prohibitively) disliked to eat horse meat according to (Imaam) Abu Haneefah (Rahimahullaah).” [i]

 

He then mentions:

 

“According to Abu Yusuf, Muhammad and Ash-Shaafi`i Rahimahumullaah they say: “There is no harm in eating it (i.e. horse meat) because of the Hadeeth of (Hadhrat) Jaabir Radhiallaahu `Anhu who said: “Rasoolullaah Sallallaahu `Alayhi Wa Sallam prohibited the eating of the meat of domestic donkeys on the day of (the conquest of) khaybar, and he (Sallallaahu `Alayhi Wa Sallam) gave permission to eat the meat of horses.”” [ii]

 

This Hadeeth is reported by Imaam Muslim Rahimahullaah in his Saheeh. [iii]

 

However Imaam Abu Haneefah Rahimahullaah retracted this view (of impermissibility) at the end of his life and followed the view of its permissibility, though he said that it is better not to eat it.

 

Imaam Al-Haskafi Rahimahullaah mentions in Ad-Durrul  Mukhtaar:

 

“It was mentioned that (Imaam) Abu Haneefah (Rahimahullaah) retracted this view three days before he passed away, and the Fatwaa is upon that (i.e. its permissibility).” [iv]

 

Imaam Ibn `Aabideen Rahimahullaah narrates in Raddul Muhtaar the words of Imaam Abu As-Su`ood Rahimahullaah who said:

 

“There is no difference between the Imaam (Abu Haneefah Rahimahullaah) and his two companions (Imaam Abu Yusuf and Imaam Muhammad Rahimahumallaah), because though they said it is permissible but it is disliked (i.e. better not to do so).” [v]

 

So in summary, a person should try and avoid eating horses, but if he does eat it then it will be permissible.

 [iv]وَقِيلَ إنَّ أَبَا حَنِيفَةَ رَجَعَ عَنْ حُرْمَتِهِ قَبْلَ مَوْتِهِ بِثَلَاثَةِ أَيَّامٍ وَعَلَيْهِ الْفَتْوَى.  ذكره الإمام الحصكفي رحمه الله في كتابه الدر المختار.

 [v]لَا خِلَافَ بَيْنَ الْإِمَامِ وَصَاحِبَيْهِ لِأَنَّهُمَا وَإِنْ قَالَا بِالْحِلِّ لَكِنْ مَعَ كَرَاهَةِ التَّنْزِيهِ.  ذكره الإمام ابن عابدين رحمه الله في كتابه رد المحتار.

A lot of products use white wine or spirit vinegar.

 

Question:

 

A lot of products use white wine or spirit vinegar . is it halaal to consume?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Any product which contains white wine or any type of wine, will be haraam, because of its express prohibition in the Qur’aan, Allaah says in Surah Maa’idah Aayah 90: “O you who have believed, indeed intoxicants, gambling, idol worship and divining by arrows are filth from the actions of the devil, so abstain from it in order that you may be successful.” [i]

 

But if you mean white wine vinegar, which is simply wine that has become vinegar, then that according to the Hanafi Madhab is permissible, the same applies to spirit vinegar.

 

Imaam Al-Margheenaani Rahimahullaah says in Al-Hidaayah: “If wine becomes vinegar, it will be permissible regardless of whether it became vinegar on its own, or due to something added to it, and it is not Makrooh to make it into vinegar.” [ii]

 

 

Imaam As-Sarakhsi Rahimahullaah says in Al-Mabsoot: “The root of the matter is that turning wine into vinegar by treating it is permissible according to us, and it will be permissible to use the vinegar once it has been changed.” [iii]
