Odd number of rows for janazah salaat

 

Question:

 

Is there any basis for the practice of having an odd number of rows for janazah salaat?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

The practice of making three rows is based on the Hadeeth of Hadhrat Maalik Ibn Hubayrah Radhiallaahu `Anhu which Imaam At-Tirmidhi Rahimahullaah and others report, the narration which is reported in the Sunan of Imaam At-Tirmidhi Rahimahullaah is:

 

“Marthad Ibn `Abdillaah Al-Yazani said: “When (Hadhrat) Maalik Ibn Hubayrah (Radhiallaahu `Anhu) would perform the Janaazah Salaah and the people were few, he would divide them into three rows, then he said: “Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “Whoever has three rows (of people) perform Salaah over him, then he is guaranteed (Jannah).”” [i]

 

Imaam Badruddeen Al-`Ayni Rahimahullaah comments on a similar Hadeeth in `Umdatul Qaari and says:  “In it (i.e. the hadeeth, and what we learn from it) is performing Salaah on the deceased in rows, and that it has an effect, and the Sahaabi (Hadhrat) Maalik Ibn Hubayrah Radhiallaahu Ta`aalaa `Anhu would form the people present for the Janaazah into three rows, regardless of whether they were a little or a lot.” [ii]

 

Imaam Ibn `Aabideen Rahimahullaah mentions in Raddul Muhtaar: “For this reason it is mentioned in Al-Muheet: “It is preferable to have three rows, so much so that if they are seven people, one will go forward to lead the Salaah, then three shall stand behind him, then two behind them, and then one (in the last row).”” [iii]

 

So both the Hadeeth and the action of Hadhrat Maalik Radhiallaahu `Anhu points out to the virtue of having three rows, this special virtue is not attached to “an odd number” although odd numbers in general are good based on the Hadeeth of Saheeh Muslim which says:
“Allaah has ninety-nine Names, whoever memorises it shall enter Jannah, and indeed Allaah is One and He loves odd numbers.” [iv]

 

To make any other number of rows will also be permissible.

 

Imaam As-Sughdi Rahimahullaah says in An-Nutafu Fil Fataawaa:

 

“As for the people, when they stand over the deceased (for Salaah), they should form three rows even if they are few in number, because that is best and it has been mentioned in narrations, but if they stand contrary to that then it will be permissible.” [v]

 

So in conclusion, the Sunnah method is to have three rows, not five or seven or any other odd number, but if a different odd number is made then it will be permissible but the special virtues mentioned in the Hadeeth will not apply to it, and lastly even if an even number of rows is made then too it will be permissible. But the best is to have three rows.

[i]عَنْ مَرْثَدِ بْنِ عَبْدِ اللهِ اليَزَنِيِّ، قَالَ: كَانَ مَالِكُ بْنُ هُبَيْرَةَ، إِذَا صَلَّى عَلَى جَنَازَةٍ، فَتَقَالَّ النَّاسَ عَلَيْهَا، جَزَّأَهُمْ ثَلاَثَةَ أَجْزَاءٍ، ثُمَّ قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: مَنْ صَلَّى عَلَيْهِ ثَلاَثَةُ صُفُوفٍ فَقَدْ أَوْجَبَ. – رواه الإمام الترمذي رحمه الله في سننه وحسنه.

 

 [ii]فِيهِ الصَّلَاة على الْجِنَازَة بالصفوف، وَأَن لَهَا تَأْثِيرا، وَكَانَ مَالك بن هُبَيْرَة الصَّحَابِيّ، رَضِي الله تَعَالَى عَنهُ، يصف من يحضر الصَّلَاة على الْجِنَازَة ثَلَاثَة صُفُوف، سَوَاء قلوا أَو كَثُرُوا. – قاله الإمام بدر الدين العيني رحمه الله في كتابه عمدة القاري شرح صحيح البخاري.

 

 [iii]وَلِهَذَا قَالَ فِي الْمُحِيطِ: وَيُسْتَحَبُّ أَنْ يُصَفَّ ثَلَاثَةُ صُفُوفٍ، حَتَّى لَوْ كَانُوا سَبْعَةً يَتَقَدَّمُ أَحَدُهُمْ لِلْإِمَامَةِ، وَيَقِفُ وَرَاءَهُ ثَلَاثَةٌ ثُمَّ اثْنَانِ ثُمَّ وَاحِدٌ. قاله الإمام ابن عابدين رحمه الله في كتابه رد المحتار على الدر المختار.

 

 [iv]«لِلَّهِ تِسْعَةٌ وَتِسْعُونَ اسْمًا، مَنْ حَفِظَهَا دَخَلَ الْجَنَّةَ، وَإِنَّ اللهَ وِتْرٌ، يُحِبُّ الْوِتْرَ». – رواه الإمام مسلم رحمه الله في صحيحه.

 

 [v]فَأَما الْقَوْم اذا قَامُوا على الْجِنَازَة يَنْبَغِي ان يقومُوا ثَلَاثَة صُفُوف وان قلوا لَان ذَلِك أفضل وَقد جَاءَت الاثار بذلك وان قَامُوا بِخِلَاف ذَلِك جَازَ. – قاله الإمام السغدي رحمه الله في كتابه النتف في الفتاوى.

Attending funeral procession of Christian family

 

Question:

 

Salaams moulana, my question pertain to attending the funeral procession of our christian family, brother, sister, mother, father, etc. Close relatives only. Our family both close as well as extended, on my side as well as on my wifes side are all christian, how do we deal with this matter in the future, in order to avoid ill feelings or disputes amongst us.

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Wa `alaykumus salaam.

 

It is not permissible for a muslim to attend the funeral of a non muslim, be they family or not.

 

Allaah says in Surah Tawbah, Aayah 84:

وَلَا تُصَلِّ عَلَى أَحَدٍ مِنْهُمْ مَاتَ أَبَدًا وَلَا تَقُمْ عَلَى قَبْرِهِ إِنَّهُمْ كَفَرُوا بِاللَّهِ وَرَسُولِهِ وَمَاتُوا وَهُمْ فَاسِقُونَ.

 

“And do not ever pray over any of them that has died, and do not stand at his grave, indeed they had disbelieved in Allaah and His messenger and died while they were openly disobedient.” [i]

 

Allaah revealed this Aayah after the death of the leader of the hypocrites, `Abdullaah ibn Ubayy ibn Salool, thereby putting a permanent end to Janaazah Salaah for all Kuffaar, because these Munaafiqeen (hypocrites) were not Muslim even though they professed to be such. So if it is prohibited for a hypocrite, then the prohibition for people that are openly kuffaar will be much stricter.

 

Janaazah Salaah is in reality a Du`aa, so from this Aayah we come to realise that it is not permissible to make any sort of supplication for a non muslim, and one common supplication which people make albeit at times without realising it, is “Rest in Peace” (or R.I.P for short), this is a supplication asking Allaah to let them rest in peace, therefore it is not permissible.

 

Allaah also says in Surah Tawbah, Aayah 113:

 

مَا كَانَ لِلنَّبِيِّ وَالَّذِينَ آمَنُوا أَنْ يَسْتَغْفِرُوا لِلْمُشْرِكِينَ وَلَوْ كَانُوا أُولِي قُرْبَى مِنْ بَعْدِ مَا تَبَيَّنَ لَهُمْ أَنَّهُمْ أَصْحَابُ الْجَحِيمِ.

 

“It is not (correct and befitting) for the Nabi and those who have believed, to seek forgiveness for the polytheists even if they were relatives, after it has been made clear to them that they (the disbelievers) are the companions of the hellfire.” [ii]

 

When this is the case regarding Islaamic matters like du`aa etc, then what still about attending the church service, and hearing the sermon of kufr given there and at the graveside

 

However, what is permissible is to offer one’s condolences to the family without making any supplication for the deceased.

 

It is stated in Al-Fataawaa Al-Hindiyyah:

 

 “If a kaafir dies, one may say to his (the deceased’s) father or family: “May Allaah recompense you with someone better, and correct you – i.e. correct you with Islaam (by making you muslim) – and grant you a muslim child.”” [iii]

The reason for this sort of du`aa being permissible is because any mention of “goodness” or “betterment” etc is used to refer to Islaam, so it’s actually a du`aa asking Allaah to guide this person to Islaam, and this kind of du`aa is permissible as long as a person is alive, but once they die then no du`aa can be made for them anymore.

 

So there is no harm in visiting your Christian family at their home and offering your condolences, however you should go at a time when there is no bible reading or praying taking place, but you may not take part in any of the funeral services.

Does the grave have to be dug a certain depth?

 

Question:

 

Salaams. Mufti saheb does the grave have to be dug a certain length in depth eg. 6 foot, 8 foot, etc.

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Wa `alaykumus salaam.

 

The purpose of the depth of grave is to prevent the smell from escaping, and to prevent wild animals from eating the body.

 

Imaam Al-Haskafy Rahimahullaah says in Ad-Durrul Mukhtaar:

 

“(The grave should be at least) The depth of half a person’s height, but if it’s deeper then it is better.” [i]

 

Imaam Ibn `Aabideen Rahimahullaah comments on that and says in Raddul Muhtaar:

 

“His statement ‘The depth of half a person’s height…’ or until the height of a person’s chest, but if it’s made deeper until the height of a person then that is best, as in mentioned in Adh-Dhakheerah, so you come to know that the minimum depth is the height of half a person while the maximum is the height of a person.”[ii]

 

He continues and quotes Imaam Al-Quhustaani Rahimahullaah who said:

 

“Its depth should be the height of the person, and its width should be half his height.” [iii]

 

Thus the minimum depth should be half the height of a person, and the maximum depth should be the height of a person.

Mubashir and Bashir

 

Question:

 

Some ‘Ulama have said: “Munkar+Nakir are the Angels who will question the sinners in their graves. The righteous will be Questioned by: Mubashir and Bashir”.

Can someone explain the abvove

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Imaam Ibn Hajar Al-`Asqalaanee Rahimahullaah mentions in Fathul Baari: “And some of the Fuqahaa (jurists) have said that the names of the two (angels) who will question a sinner are Munkar and Nakeer, and the names of the two who will question an obedient person are Mubashshir and Basheer.”  [i]

 

However Imaam As-Safaareenee Rahimahullaah says in Lawaami`u Anwaaril Bahiyyah: “Ibn Yoonus of the Shaafi`iyyah has said that the names of the two angels (that will question) of a believer are Mubashshir and Basheer. I say: This requires textual proof (from ahaadeeth), and where will such a thing come from, because there is nothing in the Ahaadeeth besides Munkar and Nakeer, and As-Suyooti had indicated towards that in his poetry by saying:

The diacritical mark of Munkar is with a Fathah on the Kaaf (i.e. not Munkir)…. And I do not know of any difference concerning it.

Ibn Yoonus of our companions had mentioned…. That the two (angels) that will come to a believer.

Their names are Al-Basheer and Al-Mubashshir…. But I have not come across a narration regarding it.” [ii]

 

But the most moderate is what Mullaa `Ali Al-Qaaree Rahimahullaah says in Mirqaatul Mafaateeh: “Two angels come to him (the deceased), that is Al-Munkar and An-Nakeer, but in the form of a Mubashshir and a Basheer (giver of glad tidings).”  [iii]

 

So in conclusion we can say that Munkar and Nakeer are the two angels who visit everyone, be they good or bad, but their appearance will differ depending on whether the person was good or bad.

 

For the good people they’ll appear in good forms giving them glad tidings of Jannah, but if they are evil then they will appear in scary hideous forms as a further means of punishment.

 [i]وَذَكَرَ بَعْضُ الْفُقَهَاءِ أَنَّ اسْمَ اللَّذَيْنِ يَسْأَلَانِ الْمُذْنِبَ مُنْكَرٌ وَنَكِيرٌ وَأَنَّ اسْمَ اللَّذَيْنِ يَسْأَلَانِ الْمُطِيعَ مُبَشِّرٌ وَبَشِيرٌ.

 [ii]وَذَكَرَ ابْنُ يُونُسَ مِنَ الشَّافِعِيَّةِ أَنَّ اسْمَ مَلَكَيِ الْمُؤْمِنِ مُبَشِّرٌ وَبَشِيرٌ قُلْتُ: وَهَذَا يَحْتَاجُ إِلَى دَلِيلٍ مَأْثُورٍ وَأَنَّى بِهِ فَإِنَّ الْأَحَادِيثَ لَيْسَ فِيهَا سِوَى مُنْكَرٍ وَنَكِيرٍ وَقَدْ أَشَارَ إِلَى ذَلِكَ السُّيُوطِيُّ فِي أُرْجُوزَتِهِ بِقَوْلِهِ:

وَضَبْطُ مُنْكَرٍ بِفَتْحِ كَافِ … فَلَسْتُ أَدْرِي فِيهِ مِنْ خِلَافِ

وَذَكَرَ ابْنُ يُونُسَ مِنْ صَحْبِنَا … أَنَّ اللَّذَيْنِ يَأْتِيَانِ الْمُؤْمِنَا

اسْمُهُمَا الْبَشِيرُ وَالْمُبَشِّرُ … وَلَمْ أَقِفْ فِي ذَا عَلَى مَا يُؤْثَرُ.

 [iii](يَأْتِيهِ مَلَكَانِ) أَيِ: الْمُنْكَرُ وَالنَّكِيرُ لَكِنْ فِي صُورَةِ مُبَشِّرٍ وَبَشِيرٍ.

Communicating with people beyond the grave

 

Question:

 

Wslm. I would like to pose a question on Crossing Over. That is a MEDIUM communicating with people beyond the grave. Is it right for me to say it isn’t possible. What is the ruling. Annie Dewani according to the Argus has contacted a local psychic to call her parents. Wslm.

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

People who claim to be psychics are tricksters and charlatans, while some are satanists who deal with the Shayaateen and receive information from them, but definitely they are not contacting the dead.

 

Allaah says in Surah Faatir Aayah 22: “And you cannot make the inmates of the grave hear.” [i]

 

Nor do the dead contact the living.

 

Hadhrat Jaabir Ibn `Abdillaah Radhiallaahu `Anhu narrates that when Hadhrat `Abdullaah Ibn `Amr Radhiallaahu `Anhu (his father) was martyred on the day of Uhud, Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “O Jaabir, should I not inform you of what Allaah `Azza Wa Jall told your father?” I said: “Indeed.” He (Sallallaahu `Alayhi Wa Sallam said: “Allaah has not spoken to anyone but from behind a screen, but He spoke to your father openly.” He (Allaah) said: “O My servant, request anything from Me and I shall give it to you.” He (Hadhrat `Abdullaah Radhiallaahu `Anhu) said: “O my Lord, return me to life so that I can be killed for Your sake again.” He (Allaah) said: “The decision has already been passed by Me that none of them (people) shall return to it (the world).” He (Hadhrat `Abdullaah Radhiallaahu `Anhu) said: “O my Lord, inform those (who I have left) behind me.” Then Allaah `Azza Wa Jall revealed this verse in its entirety: “And do not think that those who are killed in the path of Allaah are dead…” [ii] [iii]

 

The same happened with the seventy Qurraa that were martyred.

 

These were the greatest of people after the Ambiyaa `Alayhimus Salaam yet they could not just make contact with the living as they wished, so how can the Kuffaar simply contact the living whenever they want?

 

When a person dies he is either a good Mu’min, and he finds himself in peace and tranquillity, or he’s evil, and he finds himself in pain and punishment. If anyone were to have the ability to interact with this world after death it would be the good people, but they cannot do so, so what still about evil people who neither has the time nor the ability to do anything.

 [iii]جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ: لَمَّا قُتِلَ عَبْدُ اللَّهِ بْنُ عَمْرِو بْنِ حَرَامٍ يَوْمَ أُحُدٍ، قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «يَا جَابِرُ، أَلَا أُخْبِرُكَ مَا قَالَ اللَّهُ عَزَّ وَجَلَّ لِأَبِيكَ؟» قُلْتُ: بَلَى، قَالَ: ” مَا كَلَّمَ اللَّهُ أَحَدًا إِلَّا مِنْ وَرَاءِ حِجَابٍ، وَكَلَّمَ أَبَاكَ كِفَاحًا فَقَالَ: يَا عَبْدِي، تَمَنَّ عَلَيَّ أُعْطِكَ، قَالَ: يَا رَبِّ، تُحْيِينِي فَأُقْتَلُ فِيكَ ثَانِيَةً، قَالَ: إِنَّهُ سَبَقَ مِنِّي أَنَّهُمْ إِلَيْهَا لَا يُرْجَعُونَ. قَالَ: يَا رَبِّ، فَأَبْلِغْ مَنْ وَرَائِي، فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ هَذِهِ الْآيَةَ “: {وَلَا تَحْسَبَنَّ الَّذِينَ قُتِلُوا فِي سَبِيلِ اللَّهِ أَمْوَاتًا} [آل عمران: 169] الْآيَةَ كُلَّهَا. – رواه ابن ماجه رحمه الله في سننه بسند حسن.

Answer:

 

Bismillaahir Rahmaanir Raheem.

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

It is not permissible to give Ghusl to a shia, nor to perform Janaazah Salaah for them, nor to attend their funerals, because they are not Muslim, and these things are only permitted for Muslims.

 

The shia follow a different religion to Islaam even if they claim to be of its people, the `Ulamaa throughout the ages have authored books exposing and explaining the Kufr of the Shia.

 

The shia have multiple facets of Kufr, each of which is enough to expel them from Islaam, such as their rejection and reviling of the Sahaabah Radhiallaahu `Anhum, their claim that parts of the Qur’aan is missing, their belief in the infallibility of the Imaams, their belief that their Imaams and some other people will come back to life after the coming of the shia mahdi to take revenge etc.

 

Moosaa Ibn Haaroon Rahimahullaah said:  I heard (Imaam) Al-Firyaabee Rahimahullaah being asked about a person who insults (Hadhrat) Abu Bakr Radhiallaahu `Anhu, so he replied: “(He is) A Kaafir.” Then the man asked “should (Janaazah) Salaah be read over him?” He replied: “No.” So I asked him: “What should be done with him when he says Laa Ilaaha Illallaah?” He replied: “Don’t touch him with your hands, but lift him with a piece of wood and cast him into his pit.” Reported in As-Sunnah of Imaam Abu Bakr Al-Khallaal Rahimahullaah. [i]

 

Imaam Al-Bukhaari Rahimahullaah says in Khalq Af`aalul `Ibaad: “I see no difference between performing Salaah behind a Jahmi (one of the early sects), and a Raafidhi (shia), and performing behind a Jew or a Christian. They should not be greeted, nor are they to be visited when they’re ill, nor are they to be married, nor should their testimony be accepted, nor should the animals they slaughter be eaten.” [ii]

 

It is mentioned in Al-Fataawaa Al-Hindiyyah: “Whoever denies the Imaamah (the legitimacy of being the Khaleefah) of (Hadhrat) Abu Bakr As-Siddeeq Radhiallaahu `Anhu then he is a Kaafir, some have said he’s an innovator and not a Kaafir, but the correct view is that he is a Kaafir.” [iii]

 

It is further stated in Al-Fataawaa Al-Hindiyyah: “It is compulsory to declare the Raafidhah as disbelievers due to them saying the dead will return to the world.” [iv]

 

Taqiyyah (lying) is part of the shia religion, so you may find some who claim that they do not hold these beliefs, to them we say as Moulana Yusuf Ludhianvi Rahimahullaah says in Aap Kay Masa’il Aur Un Ke Hal: “If anyone (shia) says that he does not believe this (kufr beliefs of the shia), then it is obligatory upon him to make known his denunciation of the religion (shiaism) that believes this, and to declare those who believe it as Kaafir. As long as he does not do this we will not accept his claim, and his claim (of not believing it) will be considered Taqiyyah.” [v]

 

Regarding Janaazah Salaah upon Kuffaar, Allaah says in Surah Tawbah, Aayah 84: “And do not ever perform Salaah upon any of them who dies, nor stand by their grave…” [vi]

 

So taking that into consideration it becomes clear that we may not make Ghusl of them, nor may we perform Salaah over them.

[i]  ثَنَا مُوسَى بْنُ هَارُونَ بْنِ زِيَادٍ، قَالَ: سَمِعْتُ الْفِرْيَابِيُّ، وَرَجُلٌ يَسْأَلُهُ عَمَّنْ شَتَمَ أَبَا بَكْرٍ قَالَ: كَافِرٌ، قَالَ: فَيُصَلَّى عَلَيْهِ؟ قَالَ: لَا، وَسَأَلْتُهُ كَيْفَ يُصْنَعُ بِهِ وَهُو يَقُولُ: لَا إِلَهَ إِلَّا اللَّهُ؟ قَالَ: لَا تَمَسُّوهُ بِأَيْدِيكُمْ، ارْفَعُوهُ بِالْخَشَبِ حَتَّى تُوَارُوهُ فِي حُفْرَتِهِ – السنة للإمام أبي بكر الخلال.

[ii]  قَالَ أَبُو عَبْدِ اللَّهِ: مَا أُبَالِي صَلَّيْتُ خَلْفَ الْجَهْمِيِّ والرَّافِضِيِّ أَمْ صَلَّيْتُ خَلْفَ الْيَهُودِ وَالنَّصَارَى، وَلَا يُسَلَّمُ عَلَيْهِمْ، وَلَا يُعَادُونَ، وَلَا يُنَاكَحُونَ، وَلَا يَشْهَدُونَ، وَلَا تُؤْكَلُ ذَبَائِحُهُمْ

 [iii] مَنْ أَنْكَرَ إمَامَةَ أَبِي بَكْرٍ الصِّدِّيقِ – رَضِيَ اللَّهُ عَنْهُ -، فَهُوَ كَافِرٌ، وَعَلَى قَوْلِ بَعْضِهِمْ هُوَ مُبْتَدِعٌ وَلَيْسَ بِكَافِرٍ وَالصَّحِيحُ أَنَّهُ كَافِرٌ

 [iv]وَيَجِبُ إكْفَارُ الرَّوَافِضِ فِي قَوْلِهِمْ بِرَجْعَةِ الْأَمْوَاتِ إلَى الدُّنْيَا
