Does my wudhu remain if I swear? Swearing meaning profanity, foul language

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

The nullifiers of Wudhoo are known from the Qur’aan and Sunnah, and there is no authentic narration of swearing being one of them, therefore swearing will not affect one’s Wudhoo.

 

Imaam Al-Jawraqaani Rahimahullaah reports in Al-Abaateel Wal Manaakeer Was Sihaah Wal Mashaaheer from Hadhrat Anas Radhiallaahu `Anhu who said that Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “Five things break a person’s fast, and nullifies Wudhoo: Lying, carrying tales, backbiting, lustful gazes and false oaths.”

 

Imaam Al-Jawraqaani Rahimahullaah after reporting this narration comments on it and says: “This is a false Hadeeth.” [i]

 

Imaam Ibn Al-Jawzi Rahimahullaah reports in Al-`Ilalul Mutanaahiyah Fil Ahaadeetil Waahiyah from  Hadhrat `Abdullaah Ibn `Abbaas Radhiallaahu `Anhumaa who said that Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “Al-Hadath (minor ritual impurity) is of two types, Hadath of the tongue and Hadath of the private part, the Hadath of the tongue is the worse one of the two, and Wudhoo is required for both of them.”

 

Imaam Ibn Al-Jawzi Rahimahullaah then comments on this narration and says: “This narration is not authentic from Rasoolullaah Sallallaahu `Alayhi Wa Sallam.” [ii]

 

Imaam an-Nawawi Rahimahullaah says in Al-Majmoo` Sharhul Muhadhdhab that Imaam Ibn Al-Mundhir has mentioned in his two books Al-Ashraaf and Al-Ijmaa`, and Imaam Ibn As-Sabbaagh as well (has mentioned): “The scholars have consensus that it is not obligatory to perform Wudhoo from speaking bad things, like backbiting, slander, lies and other (bad) things besides that.” [iii]

 

So while swearing is a bad thing, it will not break one’s Wudhoo.

 [i]عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: ” خَمْسٌ يُفْطِرْنَ الصَّائِمَ، وَيُنْقُضْنَ الْوُضُوءَ: الْكَذِبُ، وَالنَّمِيمَةُ، وَالْغَيْبَةُ، وَالنَّظَرُ بِالشَّهْوَةِ، وَالْيَمِينُ الْكَاذِبَةُ “. هَذَا حَدِيثٌ بَاطِلٌ. – قاله الإمام الجورقاني رحمه الله في كتابه الأباطيل والمناكير والصحاح والمشاهير.

 

 [ii]عَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:”الْحَدَثُ حَدَثَانِ حَدَثً اللِّسَانِ وَحَدَثُ الْفَرْجِ وَحَدَثُ اللِّسَانِ أَشَدُّ مُنْ حَدَثِ الْفَرْجِ وَفِيهِمَا الْوُضُوءُ”.

قَالَ الْمُصَنِّفُ: هَذَا حَدِيثٌ لا يَصِحُّ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. – قاله الإمام ابن الجوزي رحمه الله في كتابه العلل المتناهية في الأحاديث الواهية.

 [iii]قَالَ ابْنُ الْمُنْذِرِ فِي كِتَابَيْهِ الْأَشْرَافِ وَالْإِجْمَاعِ وَابْنُ الصَّبَّاغِ أَجْمَعَ الْعُلَمَاءُ عَلَى أَنَّهُ لَا يَجِبُ الْوُضُوءُ مِنْ الْكَلَامِ الْقَبِيحِ كَالْغِيبَةِ وَالْقَذْفِ وَقَوْلِ الزُّورِ وَغَيْرِهَا. – قاله الإمام النووي رحمه الله في كتابه المجموع شرح المهذب.

Conditional divorce

 

Question:

 

A divorce that takes place upon a condition being broken, is that divorce a raji or bain?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Conditions actually have no effect on the type of divorce at all, it is the words used that causes it to be Raj`i (revocable) or Baa’in (irrevocable).

 

A Talaaq which is Mu`allaq (attached) to a condition being broken such as: If you enter that house then you are divorced etc is considered to be a Raj`i (revocable) divorce because it is Sareeh (explicit), thus it will not be necessary to renew the Nikaah with her if he wishes to take back his wife, as long as she is still in her `Iddah (waiting period following divorce).

 

Likewise if such ambiguous (Kinaayah) words are used with the intention of divorce, such as: If you leave this house without me again then I’m sending you back to your mother, then one Baa’in (irrevocable) Talaaq will take place upon her breaking that condition, and if he wants to take her back as his wife then he will have to renew his Nikaah.

 

Imaam Al-Kaasaani Rahimahullaah mentions in Badaa’i`us Sanaa`i: “And there is no difference of opinion that divorce does not take place with any of these ambiguous wordings except with an intention, so if he intended divorce then it will take place between him and Allaah Ta`aalaa, but if he did not intend anything then between him and Allaah Ta`aalaa nothing (no divorce) will take place, and if he mentions any of these (ambiguous wordings) and then (falsely) says: “I did not intend divorce.” He will be liable for that by Allaah Ta`aalaa, because Allaah Ta`aalaa knows his secrets and what he conceals.” [i]

Dua-e-Jamila

Dua-e-Jamila

 

Question:

 

I heard about this dua called dua-e-jamila, it is said to have a lot of benefits and was taught to the prophet by the angel jibril, the text of it is:

It is said that the one who recites it after Tahajjud it is as though he has performed one hundred thousand [100.000] Hajj receiving the barakah of the Hajj as performed By Sayyidina Rasulli Akram Sall Allahu alaihi wa Aalihi wa Sallim.

 

And there are many more benefits said to be gained by reading it or keeping it with you.

 

Is this correct and authentic?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

There is no record at all of this Du`aa being reported from Rasoolullaah Sallallaahu `Alayhi Wa Sallam, so it is a fabrication attributed to Rasoolullaah Sallallaahu `Alayhi Wa Sallam which is a very serious matter, because Hadhrat Salamah Radhiallaahu `Anhu reports that Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “Whoever attributes something to me which I have not said, then let him prepare his abode in the fire (of hell).” – Authentic, from Saheeh Al-Bukhaari.  [i]

 

There is nothing wrong with the words of this Du`aa, but it cannot and may not be attributed to Rasoolullaah Sallallaahu `Alayhi Wa Sallam.

 

Furthermore the benefits and virtues attributed to this Du`aa are also all false, due to the narration being a fabrication, and it is not permissible for anyone to make up their own rewards for deeds.

This has become a rather common problem amongst the laity today, where every tom john and harry who in reality knows nothing about anything, starts claiming that one should not follow a madhab, but should rather follow the Qur’aan and Sunnah directly, they claim beyond that still that the scholars are the ones that have said so.

 

The following video of Shaykh Fawzaan, who is one of the senior Salafi ghayr Muqallideen scholars of today, is in reply to that claim of the laymen.

Naturally there are certain aspects on which we disagree with this video, but on the whole it adequately responds to that claim of the ghayr muqallid laypeople who advise people against following Madhaahib.

 

These laypeople are under the misconception that those statements and articles of the scholars that they came across which speaks of following the Qur’aan and Sunnah directly are in some way directed at them, whereas in reality it has nothing whatsoever to do with them.

 

Those statements were directed at `Ulamaa, not laypeople.

 

I have not come across a single ghayr muqallid scholar that advises the laypeople to mess with the deen by claiming to follow the Qur’aan and Sunnah directly, rather they obligate the layman to make taqleed, whether that taqleed is of a madhab or of a particular scholar is a different story, but they advocate taqleed upon the laypeople nonetheless.

 

May Allaah guide us all to the straight path.

I and Abu Bakr are created from the same dust

 

Question:

 

Need some help pls someone asked for the references of this hadith ” I صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ and abu bakr رضي الله عنه are created from the same dust”.

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

There are a few narrations all having slight changes in the wording, some mentioning just Rasoolullaah Sallallaahu `Alayhi Wa Sallam and Hadhrat Abu Bakr Radhiallaahu `Anhu, while others mention Rasoolullaah Sallallaahu `Alayhi Wa Sallam, Hadhrat Abu Bakr and Hadhrat `Umar Radhiallaahu `Anhumaa. However none of the narrations are authentic.

 

Imaam Ad-Daylami Rahimahullaah reports in his Musnadul Firdows from Hadhrat Anas Radhiallaahu `Anhu that Rasooolullaah Sallallaahu`Alayhi Wa Sallam said: “Every newborn which is born has (some) sand from which it was created and into which it will be buried, and indeed I and Abu Bakr were created from the same sand, from it we were created and into it we shall be buried.” [i]

 

Imaam Ash-Shawkaani Rahimahullaah reports in Al-Fawaa’idul Majmoo`ah Fil Ahaadeethil Mawdhoo`ah that Imaam Ibn `Adi Rahimahullaah narrates from Hadhrat Anas Radhiallaahu `Anhu who said that Rasoolullaah Sallallaahu `Alayhi Wa Sallam said: “Whoever fabricates a lie upon Allaah `Azza Wa Jall is to be killed and should not asked to repent, and whoever insults me should be killed and not asked to repent, and whoever insults Abu Bakr and `Umar should be killed and not asked to repent, and whoever insults `Uthmaan should be lashed, and whoever insults `Ali should be lashed.” He (Sallallaahu `Alayhi Wa Sallam) said: “Because Allaah created me and the two of them (Hadhrat Abu Bakr and Hadhrat `Umar) from the same sand, and in it (that sand) we shall be buried.” Imaam Ash-Shawkaani Rahimahullaah then comments and says: “It is fabricated.” [ii]

 

Imaam Adh-Dhahabi Rahimahullaah reports a similar narration in Meezaaul I`tidaal and then says: “This is a fabricated Hadeeth.” [iii]

 

Imaam Ibn Hajar Al-`Asqalaani Rahimahullaah reports the same narration in Lisaanul Meezaan and says: “This is a fabricated Hadeeth.” [iv]

 [i]أنس بن مَالك: كل مَوْلُود يُولد لَهُ تربة مِنْهَا يخلق وفيهَا يدْفن فَإِنِّي خلقت أَنا وَأَبُو بكر من تربة وَاحِدَة مِنْهَا خلقنَا وفيهَا ندفن. – رواه الإمام الديلمي رحمه الله في مسنده.

 

 [ii]مَنِ افْتَرَى عَلَى اللَّهِ عَزَّ وَجَلَّ كَذِبًا: قُتِلَ وَلا يُسْتَتَابُ، وَمَنْ سَبَّنِي: قُتِلَ وَلا يُسْتَتَابُ، وَمَنْ سَبَّ أَبَا بَكْرٍ وَعُمَرَ: قُتِلَ وَلا يُسْتَتَابُ. وَمَنْ سَبَّ عُثْمَانَ: جُلِدُ الْحَدَّ، وَمَنْ سَبَّ عَلِيًّا: جُلِدَ الْحَدَّ. قَالَ: لأَنَّ اللَّهَ خَلَقَنِي وَخَلَقَهُمَا مِنْ تُرْبَةٍ وَاحِدَةٍ، وَفِيهَا نُدْفَنُ” رواه ابن عَدِيٍّ عَنْ أَنَسٍ مَرْفُوعًا، وَهُوَ موضوع. – ذكره الإمام الشوكاني رحمه الله في كتابه الفوائد المجموعة.

 

 [iii]عن أنس، قال رسول الله صلى الله عليه وسلم: من افترى على الله كذبا قتل ولا يستتاب. ومن سبنى قتل ولا يستتاب. ومن سب أبا بكر قتل ولا يستتاب. ومن سب عمر قتل ولا يستتاب. ومن سب عثمان وعليا جلد الحد. قيل: يا رسول الله ولم ذاك؟ / قال: لان الله خلقني وخلق أبا بكر وعمر من تربة واحدة، وفيها ندفن. هذا حديث موضوع. – ذكره الإمام الذهبي رحمه الله في كتابه ميزان الإعتدال.

 

 [iv]عن أنس رضى الله عنه قال: قال رسول الله صلى الله عليه وآله وسلم من افترى علي كذبا قتل ولا يستتاب ومن سبني قتل ولا يستتاب ومن سب أبا بكر قتل ولا يستتاب ومن سب عمر قتل ولا يستتاب ومن سب عثمان أو عليا جلد قيل يا رسول الله ولم ذاك قال لأن الله خلقني وخلق أبا بكر وعمر من تربة واحدة وفيها ندفن هذا حديث موضوع. – ذكره الإمام ابن حجر العسقلاني رحمه الله في كتابه لسان الميزان.

Will we see Allah in jannat?

 

Question:

 

Salaam.  Is it true that we will see Allah in jannat?

 

Answer:

 

Bismillaahir Rahmaanir Raheem.

 

Alhamdulillaahi was salaatu was salaamu `alaa Rasoolillaahi wa `alaa aalihi wa sahbihi wa man waalaahu, wa ba`d:

 

Wa `alaykumus salaam.

 

Yes, it is true, the muslims will indeed see Allaah in Jannah, and this is a matter of consensus.

 

Allaah says in Surah Al-Qiyaamah, Aayah 22-23: “On that day (some) faces will be radiant. Looking at their Lord.” [i]

 

Hadhrat Jareer Radhiallaahu `Anhu narrates that Nabi Sallallaahu `Alayhi Wa Sallam said: “You shall see your Lord with your eyes.” Authentic, from Saheeh Al-Bukhaari. [ii]

 

Imaam At-Tahaawi Rahimahullaah says in Al-`Aqeedatut Tahaawiyyah: “And the seeing (of Allaah) is a fact for the people of Jannah, without encompassment or modality, as the Book of our Lord has said:  “On that day (some) faces will be radiant. Looking at their Lord.” [iii]

 [ii]عَنْ جَرِيرِ بْنِ عَبْدِ اللَّهِ، قَالَ: قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِنَّكُمْ سَتَرَوْنَ رَبَّكُمْ عِيَانًا». – رواه الإمام البخاري رحمه الله في صحيحه.
